Scope: These general terms and conditions apply to all bookings made via Flachau Tourismus, available under the domain flachau.com, as well as those made in any other way (by post, email, fax or telephone) with Flachau Tourismus as agent or organiser.
Contractual relationship between Flachau Tourismus and the guest:Flachau Tourismus as an intermediary:
Flachau Tourismus offers the guest the possibility to book travel services of third parties. In this context Flachau Tourismus does not offer any travel services on its own responsibility and does not assume any liability in this regard. Through the booking, only an intermediary contract comes into being between the guest and Flachau Tourismus, to which the regulations of § 31b ff KSchG do not apply. Flachau Tourismus therefore neither owes the guest a (travel) service within the scope of its mediation, nor does it guarantee contractual fulfilment by the accommodation provider. Flachau Tourismus as organiser: Flachau Tourismus only offers packages as organiser in exceptional cases, which are expressly referred to on the corresponding announcements (clearly marked as offers by Flachau Tourismus in the offer text).
Booking
Booking for mediated services: In the case of mediated services, reservations are passed on to the relevant accommodation business via Flachau Tourismus as a declaratory messenger on behalf of the guest. The mediation by Flachau Tourismus is free of charge for the guest.
Flachau Tourismus as organiser:In the case of travel offers (packages) provided by Flachau Tourismus as organiser (and clearly marked in the offer text as offers from Flachau Tourismus), the guest makes their reservation/booking directly with Flachau Tourismus.
Formation of the contract With the reservation, the guest submits the offer to conclude a contract to the accommodation provider (in the case of mediated services) or Flachau Tourismus (in the case of packages, whereby this is expressly referred to in the offer text). The contract comes into effect through confirmation by Flachau Tourismus. If Flachau Tourismus itself acts as organiser, the contractual relationship arises between Flachau Tourismus and the guest. The provisions of these GTC and the terms and conditions for the hotel industry (current version) are to be applied in this regard.
Payment As soon as the contract has been concluded by confirmation by Flachau Tourismus, the following payment terms apply.
Payment for mediated contracts: The accommodation provider has the right to demand a deposit as security. If he/she makes use of this right, a corresponding note is found in the offer and/or in the booking. The payment office for this deposit is the accommodation provider. The remaining travel price as well as any incidental costs (final cleaning, local taxes, electricity, etc.) are to be paid by the guest directly to the accommodation provider. If a credit card number is provided with the booking, the accommodation provider can use it in the event of a cancellation and debit the amount due. Flachau Tourismus is not responsible for the (contractual) contents (such as cancellation fees, etc.) of the individual accommodation establishments and distances itself from any liability in this regard. The accommodation provider is solely responsible for the correctness and up-to-dateness as well as the availability of the rooms.
Payment for packages offered by Flachau Tourismus as the organiser: If Flachau Tourismus acts as an organiser in its own name (especially packages), the travel price or the deposit is as already shown in the offer, as stated on the booking confirmation.
Messages from the guest Notifications of changes and cancellations by the guest can be made both for mediated services and for services offered by Flachau Tourismus itself to Flachau Tourismus or the accommodation provider. The accommodation providers in Flachau have their own cancellation conditions. For Flachau Tourismus as the organiser, the respective cancellation conditions and GTCs apply, which are stated in writing on the offer or on the booking confirmation.
Hotel categories and hotel information
Hotel classification The hotel classification is based on an inspection of the accommodation by the Professional Association of the Hotel Industry of the Austrian Federal Economic Chamber.
Additional hotel information: The additional hotel information is based on the hotel's own information. Flachau Tourismus accepts no responsibility for this information in the case of arranged tours.
Data privacy The guest acknowledges that the data entered by him/her will be processed electronically. They will only be passed on insofar as this is necessary for the implementation of the booking. It will not be passed on for any other purpose. Flachau Tourismus complies with the legal data protection regulations. We are happy to refer to our current data protection regulations at this point.
General information The General Terms and Conditions for the Hotel Industry (see above) apply to all bookings, unless expressly agreed otherwise. The place of jurisdiction for all disputes arising directly between the guest and Flachau Tourismus is agreed to be the Austrian court locally and factually responsible for the registered office of Flachau Tourismus. Furthermore, Austrian law is exclusively applicable.
Salvatory clause If sections or individual terms of this statement are not legal or correct, the content or validity of the other parts remain uninfluenced by this fact.
